Terms of Service

These Terms of Service ("Terms") govern your use of alpinescaling.com (the "Site") and the services provided by Alpine Scaling, a product of RST LLC ("Alpine Scaling," "RST LLC," "we," "us," or "our"). By using the Site or engaging our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.
Our services
Alpine Scaling builds and maintains lead-generation websites and provides related marketing services for home-service businesses. The specific scope, deliverables, and pricing for a given engagement are set out in the proposal, order, or written agreement we provide to you, which supplements these Terms. If there is a conflict, the signed agreement or order controls for that engagement.
The free audit
Our instant website audit is provided for informational purposes only, on an "as is" basis. It analyzes publicly available information about the URL you submit and may not capture every factor affecting a website's performance. It does not constitute a guarantee of results.
Fees, billing, and recurring payments
- Fees are due as described in your proposal or order. Payments are processed by our third-party payment processor.
- If you purchase a recurring plan (for example, a monthly service), you authorize us and our payment processor to charge your payment method on a recurring basis until the plan is cancelled, including any introductory pricing followed by the standard rate as disclosed at sign-up.
- You authorize charges to the payment method you provide, including charges taken by phone with your verbal authorization.
- Unless your written agreement states otherwise, fees are non-refundable once work has begun, and recurring charges already incurred are non-refundable. You can cancel future recurring charges by contacting us (see below); cancellation stops future billing but does not retroactively refund prior periods.
- If a payment fails or is past due, we may suspend services until the balance is resolved.
Your responsibilities
- Provide accurate information and the content, assets, and access we reasonably need to perform the services.
- Ensure you have the rights to any materials you provide to us (logos, images, text, etc.).
- Use the Site and services only for lawful purposes and not to infringe others' rights.
Intellectual property
You retain ownership of the content and trademarks you provide to us. We retain ownership of our pre-existing materials, templates, tools, and know-how. Upon full payment, you receive a license to use the deliverables we create for your business. The Site itself and its contents are owned by Alpine Scaling and may not be copied without permission.
No guarantee of results
Marketing and lead-generation results depend on many factors outside our control, including your market, pricing, responsiveness, and third-party platforms. We do not guarantee any specific number of leads, calls, rankings, conversions, or revenue.
Third-party services
Our services rely on third-party platforms (such as our payment processor, customer-relationship and communications platform, analytics tools, domain registrar, and hosting partners). The specific providers may change over time. Your use of those platforms may be subject to their own terms, and we are not responsible for their availability, changes, or actions.
Disclaimers
The Site and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, Alpine Scaling will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the services will not exceed the amount you paid us for the services giving rise to the claim in the three (3) months before the claim arose.
Indemnification
You agree to indemnify and hold Alpine Scaling harmless from claims arising out of content you provide, your use of the services, or your violation of these Terms or applicable law.
Term and termination
Either party may terminate an engagement as described in your agreement or, if none, with reasonable written notice. We may suspend or terminate access for non-payment or violation of these Terms. Sections that by their nature should survive termination (such as payment obligations, intellectual property, disclaimers, and limitation of liability) will survive.
Governing law
These Terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict-of-laws rules. Any disputes will be brought in the state or federal courts located in Tennessee.
Changes to these Terms
We may update these Terms from time to time. We will revise the "Last updated" date above, and your continued use of the Site or services after changes take effect constitutes acceptance.
